Last Updated: June 18, 2026

1. Acceptance of Terms

By accessing or using the website located at mcgowanappeals.com (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site. These Terms apply to all visitors, users, and others who access or use the Site.

2. No Attorney-Client Relationship / Not Legal Advice

Medicare Defense Group ("MDG," "we," "us," or "our") is a consulting firm, not a law firm. Michael McGowan and MDG are not attorneys and do not provide legal representation.

Nothing on this Site — including articles, resources, case summaries, blog posts, or any communication initiated through the Site — constitutes legal advice, creates an attorney-client relationship, or establishes a consulting engagement. You should not act or refrain from acting on the basis of any information on this Site without first seeking qualified legal counsel.

A consulting relationship with MDG is established only through a signed written agreement.

3. Scope of Services

MDG provides Medicare regulatory consulting, audit defense strategy, appeals preparation support, and related advisory services to Medicare-certified providers and the attorneys who represent them. All services are subject to a separate written engagement agreement and are governed by the terms of that agreement.

4. Intellectual Property

All content on this Site — including text, graphics, logos, images, case summaries, articles, and downloadable materials — is the property of Medicare Defense Group or its content suppliers and is protected by applicable United States and international copyright, trademark, and intellectual property laws.

You may view and print content from this Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from this Site for commercial purposes without our prior written consent.

5. Accuracy of Information

We make reasonable efforts to ensure the information on this Site is accurate and current. However, Medicare regulations, CMS policies, and administrative procedures change frequently. Information on this Site may not reflect the most recent regulatory developments. MDG makes no warranty, express or implied, regarding the completeness, accuracy, reliability, or suitability of any information on the Site.

6. Confidentiality of Submissions

Any information you submit through the Site's contact or intake forms — including details about your organization, pending audits, or legal matters — will be treated as confidential and used solely to evaluate and respond to your inquiry. Submission of information does not create a consulting or contractual relationship. Do not submit privileged or highly sensitive information through the contact form; contact us directly by phone or secure communication for sensitive matters.

7. Third-Party Links

This Site may contain links to third-party websites, including government agencies, regulatory bodies, and professional organizations. These links are provided for informational purposes only. MDG does not endorse, control, or assume responsibility for the content, privacy practices, or accuracy of any third-party site. Accessing third-party sites is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by applicable law, MDG, its principals, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of, or inability to use, this Site or its content — even if MDG has been advised of the possibility of such damages.

Your sole remedy for dissatisfaction with the Site or its content is to stop using the Site.

9. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable regulations
  • Attempt to gain unauthorized access to any portion of the Site or its related systems
  • Transmit any harmful, offensive, or disruptive content through the Site
  • Scrape, harvest, or collect information from the Site using automated means without our express written consent
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New Mexico.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
